MBTA Community Zoning Timeline

Timeline and Action Plan 

  • January 2021: MBTA Communities Law passes (MGL Ch 40A Section 3A Update)
  • April 25, 2022: Town Council gave a presentation to the Select Board on requirements of the MBTA Communities Law (per the compliance provisions, on May 2, 2022, the Town filed notice that a meet had been held)
  • August 2022: Final Compliance Guidelines for MBTA law are released (Guidelines were subsequently revised on October 21, 2022 and August 17, 2023) 
  • January 31, 2023: Town filed an Action Plan  that establishes an achievable path to zoning adoption
  • February 24, 2023: Receipt of Determination of Interim Compliance from DHCD (now EOHLC) 
  • November 2023: Planning Board brings Article 13, Amendments to the Inclusionary Zoning Bylaw, to Special Town Meeting 
  • March 2024: Planning Board and Select Board to bring MBTA Community Zoning package to Annual Town Meeting
  • 2023-2024: Economic Feasibility Analysis required
  • December 31, 2024: Wellesley, as a “Commuter Rail Community”, must be in compliance with the MBTA Communities Law
